One of the more common misconceptions is that cancelling MI is a difficult&mdash;not to mention time-consuming&mdash;process.&nbsp;<br /><br />The irony is that the majority of buyers don&rsquo;t harbor those same beliefs or reservations about an FHA insured loan when, in reality, FHA coverage may be less easily cancelled, or take longer to cancel, than MI.&nbsp;<br /><br /><strong>HPA Makes Cancellation Clearer&nbsp;</strong><br />When it went into effect as a new federal law, the Homeowners Protection Act (HPA) of 1998&mdash;which applies to both FHA and MI insured loans&mdash;required lenders and servicers to provide disclosures regarding MI for residential loans obtained on or after July 29, 1999. Prior to this, consumers were responsible for requesting MI cancellation if they met two factors: one, their loan balance was paid down to 80 percent of the property; and two, they had a good payment history.&nbsp;<br /><br />While many lenders obliged consumer requests to drop MI coverage, consumers had sole responsibility for keeping track of their loan balance.&nbsp;<br /><br />The HPA established three different times when a lender or servicer must notify consumers of their rights.&nbsp;<br /><br />At loan closing, lenders must disclose:<br />&bull;	The right to request MI cancellation and the date on which the request can be made<br />&bull;	The requirement that MI be automatically terminated and the date on which this will occur<br />&bull;	Any exemptions to the right to cancellation or automatic termination<br />&bull;	A written initial amortization schedule for fixed-rate loans only<br /><br />Each year, loan servicers must send borrowers a written statement that discloses:<br />&bull;	The right to cancel or terminate MI<br />&bull;	An address and telephone number to contact the loan servicer for determining when MI may be cancelled<br /><br />When MI coverage is cancelled or terminated, lenders must send a notification to borrowers stating:<br />&bull;	MI has been terminated, and the borrower no longer has MI coverage<br />&bull;	No further MI premiums are due<br /><br /><strong>Termination of Coverage</strong><br />Under the terms of the HPA, mortgage lenders or servicers must automatically cancel borrower-paid MI coverage when the mortgage has amortized to 78 percent of the original property value, with all unearned premiums returned to the borrower within 45 days of the cancellation or termination date. This provision also requires that the borrower be current on mortgage payments required by the terms of the loan, and if the loan is delinquent on the date of automatic termination, a lender must terminate the coverage as soon as the loan becomes current.&nbsp;<br /><br /><strong>Cancellation of Coverage</strong><br />Also under the HPA, a homeowner has the right to request MI cancellation when the mortgage balance reaches 80 percent of the original property value. All payments must be current, meaning a homeowner must not be 30 days late on a mortgage payment within one year of their request, or 60 days late within two years.&nbsp;<br /><br />However, a borrower can only initiate a cancellation request for FHA based on their prepayment of the loan, and even then, it can only be requested beginning five years after the loan origination date.<br /><br />With MI, homeowners can request cancellation based on prepayment of the loan, as well as an appraisal. Despite falling property values, it&rsquo;s possible for homeowners to gain enough equity in their home to request cancellation in less than five years based on a home appraisal.&nbsp;<br /><br /><strong>Why this Matters to Agents</strong><br />By understanding these rules and what they mean for homeowners, real estate agents can educate their buyers to help them better evaluate all of their home financing options based on facts rather than myths.&nbsp;<br /><br />This is even more important considering the FHA&rsquo;s recent price increase, which has reduced buyers&rsquo; purchasing power and increased monthly mortgage payments.&nbsp;</p>

<p align="left">The Home Affordable Foreclosure Alternatives Program (HAFA), part of the Home Affordable Modification Program (HAMP),&nbsp;provides financial incentives and simplifies Short Sales procedures by setting limits on the time it takes lenders to respond, freeing borrowers from debt and capping claims of subordinate lenders.</p>
<p align="left">The Treasury's announcement comes on the heels of more than a year's work by RE/MAX leadership to persuade federal lawmakers to address the need for a simpler Short Sale process.</p>
<p align="left">"While the plan doesn't include all of our suggestions, we feel it's a big step in the right direction," Liniger says. "These new policies will make Short Sales much more attractive to our clients and much easier for us to complete."</p>
<p align="left">With unemployment over 10 percent and millions of adjustable-rate mortgages primed to reset next year, a "tsunami" of distressed properties could be on the horizon, Liniger says. The new guidelines, as well as a growing acceptance by lenders and second-lien holders, give homeowners a better chance of closing a Short Sale rather than losing their house to foreclosure.</p>
<p align="left">Here are some of the program's key guidelines (<a href="https://www.hmpadmin.com/portal/docs/hamp_servicer/sd0909.pdf" target="_blank">download the program's full details&nbsp;in the HAMP Supplemental Directive</a>):</p>
<ul>
<li>Lenders must respond to Short Sale requests within&nbsp;10 business days of receipt of the offer package. </li>
<li>The seller will be released from all liability for repayment of the mortgage debt. </li>
<li>Subsequently, the seller is entitled to a relocation incentive of $1,500, which will be deducted from the gross sale proceeds at closing. </li>
<li>The lender will be paid $1,000 to cover administrative and processing costs for a Short Sale or a deed-in-lieu. </li>
<li>The property must be listed with a licensed real estate professional who does regular business in the community where the property is located. </li>
<li>The lender&nbsp;is prohibited from requiring, as a condition of approving the Short Sale, a reduction in the agreed-upon real estate commission.&nbsp;</li>
<li>The investor will be paid a maximum of $1,000 for allowing a total of up to $3,000 in Short Sale proceeds to be distributed to subordinate lien holders, or for allowing payment of up to $3,000 to subordinate lien holders. </li>
</ul>
<p align="left">RE/MAX leaders have been advocating Short Sale improvements for quite some time. In September, Liniger met with Housing and Urban Development Secretary Shaun Donovan and other U.S. housing officials to discuss the need for prompt action. A meeting with Sen. Harry Reid (D-Nev.) also moved the process along. <br /><br />For their part, RE/MAX Associates have embraced training in Short Sales and REOs. The network accounts for nearly 60 percent <a href="http://www.cdpe.com/schedule-now.html?affcode=remax&amp;promocode=rmmar7" target="_blank">Certified Distressed Property Expert</a> designees. That education will continue to play a vital role in order for Associates to successfully handle Short Sale transactions and establish themselves as the leading experts in their markets, Liniger says.</p>
<p align="left"><em><span style="font-family: Arial;">The official effective date is April 5, 2010, but participating mortgage servicers can begin operating under terms of the new program prior to that date if they are ready to meet all reporting requirements. </span></em></p>

Scammers are copying information, photos and text, from legitimate online rental ads and then posting that information on Craig&rsquo;s List. It is listed with a significantly reduced rent and the property manager&rsquo;s contact information has been replaced by the scammer&rsquo;s. In some ads the text is full of misspelled words and bad grammar but not always. Local scammers are often able to copy a key or simply break into a vacant property and replace the door lock with their own so they can actually provide the new tenant with a legitimate key. In one situation an unsuspecting tenant was actually able to completely move into an apartment without the knowledge of the legitimate property manager. The property manager was only alerted to the problem when the tenant called the office to request that the &ldquo;For Rent&rdquo; sign be removed from their front yard.</span></span></span></span></span></p>

Some property managers have even posted an additional listing with the same name but included, &ldquo;THIS IS A SCAM&rdquo; or similar language at the end of the post to help warn people. This way it will come up in the listing right after the fraudulent post and give the property manager an opportunity to provide the correct information.</span></p>

<span style="font-size: 10pt; font-family: &quot;Georgia&quot;,&quot;serif&quot;; color: black;">- Median Home Value: $ 207,000, down 7 percent from a year ago.<br /> - Property values are up 5 percent compared to five years ago.<br /> - Houses cost an average of $119 per square foot.<br /> - Buyers are paying 3 percent less than listing price</span></p>]]></description><link>http://www.house4u.com/Blog/Virginia-Beach-1-Place-To-Buy-A-Home-Right-Now</link><guid>http://www.house4u.com/Blog/Virginia-Beach-1-Place-To-Buy-A-Home-Right-Now</guid><pubDate>Fri, 14 Aug 2009 09:44:00 GMT</pubDate></item><item><title>It's Official - $8,000 Tax Credit Can Be Used on Closing Costs</title><description><![CDATA[<p><span style="font-family: arial,helvetica,sans-serif;"><span style="font-size: 12pt;">FHA-approved lenders received the go-ahead to develop bridge-loan products that enable first-time buyers to use the benefits of the federal tax credit upfront, according to eagerly awaited guidance from the U.S. Department of Housing and Urban Development on so-called home buyer tax credit loans that was released today.</span></span><a href="http://portal.hud.gov/pls/portal/docs/PAGE/FHA_HOME/LENDERS/MORTGAGEE_LETTERS/2009_MORTGAGEE_LETTERS/09-ML-15%20USING%20FIRST-TIME%20HOMEBUYER%20TAX%20CREDITS.PDF" target="new"></a><br /><br /><span style="font-family: arial,helvetica,sans-serif;"><span style="font-size: 12pt;">Under the guidance, FHA-approved lenders can develop bridge loans that home buyers can use to help cover their closing costs, buy down their interest rate, or put down more than the minimum 3.5 percent.<br /><br />The loans can't be used to cover the minimum 3.5 percent, senior HUD officials told reporters on a conference call Friday morning. <br /><br />Thus, buyers applying for FHA-backed financing with an FHA-approved lender that offers a bridge-loan program can get a bridge loan to bring down the upfront costs of buying a home significantly but would still have to come up with the minimum 3.5 percent downpayment.<br /><br />There remain many sources of assistance for buyers needing help with the 3.5 percent downpayment, including many state and local government instrumentalities and nonprofit lenders.<br /><br />In addition, </span></span><a href="http://www.ncsha.org/section.cfm/3/34/2920" target="new"><span style="font-family: arial,helvetica,sans-serif;"><span style="font-size: 12pt;">some state housing finance agencies</span></span></a><span style="font-family: arial,helvetica,sans-serif;"><span style="font-size: 12pt;"> have developed their own tax credit bridge loan programs, so buyers in states whose HFAs offer such programs can monetize the tax credit upfront to cover all or part of their downpayment. These programs are separate from what HUD announced today. <br /><br />The first-time homebuyer tax credit was enacted last year and improved upon earlier this year--to help encourage households to enter the housing market while interest rates are low and affordability is high. The credit is worth up to $8,000 and is available to households that haven't owned a home in at least three years.
